Lower order questions in VCE Legal studies examinations

There has been a decreasing trend in the number of marks allocated to lower order questions in VCE Legal studies examinations.

Lower order questions made up 23% of total marks in the 2021. 16% in 2022, 13% in 2023 and only 3% in the 2024 VCAA sample questions. 

Lower order questions have been categorised as questions that:

  • have simpler task words such as ‘describe’, 'explain', or ‘outline'
  • do not require students to link their responses to a legal scenario.

Here are examples of lower order questions:

  • Describe one role of community legal centres in assisting an accused.
  • Outline how a victim impact statement is used when determining a sentence.
  • Explain one reason for using class actions.

While lower order questions may still play a role, excelling in middle and higher order questions is essential to score well for the VCE legal studies exam.
